Robert Fantone Sued for Malpractice, Lies to Client About Legal Research and Writes Fake Positive Reviews on Google and Avvo
The malpractice complaint filed in the case, Tisha Gomez and Destiny Rodriguez v. Mancilla & Fantone LLP, claims that Robert Fantone billed the client for file review, examination and other services that were not performed or not necessary. The plaintiffs claims that Robert Fantone did not respond in a timely manner, billed the client for services which Robert had agreed to not charge for. Robert Fantone was allegedly reckless, negligent and careless in his representation and the legal advice he had provided.
In the email, a month before Robert Fantone was hired, Robert claimed to have done legal research on jurisdiction for a client's case and stated that because of jurisdictional issues in New York, the case won't be successful and was the reason he couldn't take the case. Robert Fantone claimed to have done research on jurisdiction for PA, NJ and NY. After hiring Robert Fantone and his firm, Robert revealed that he had not done any legal research on jurisdiction. Robert Fantone admitted that he lied about having any done legal research on jurisdiction and statute of limitations less than one week before a very important deadline for the case, if the deadline was not met, the case would have been dismissed. Because of the time constraints, the client could not immediately fire Robert and hire a new lawyer.
After admitting he lied, Robert Fantone said he would do the research and billed $900 the client for the legal research on jurisdiction and statue of limitations. Despite Robert having stated there was no jurisdiction in NY in the email a month prior, after "actually" having done legal research this time, Robert told the client there was a good chance there was jurisdiction in NY. However, when the client asked to see the legal research Robert had done, it was apparent that Robert had lied about having jurisdiction in NY. Robert wanted the client to believe there was jurisdiction and continue with the case so he could profit and make thousands of dollars from his client all while knowing the case would be dismissed for lack of jurisdiction. The client suffered immense losses and stress because of Robert Fantone's deceit and greed. The client was concerned about Robert Fantone sabotaging the case if the client confronted Robert about his lies and deceit.
Less than one week before an important deadline for the case, Robert Fantone admitted to lying about having done research on jurisdiction prior to the client hiring him. Robert charged the client for $900 for legal research on jurisdiction and statue of limitations which he said he had done prior to being hired. Robert Fantone encouraged the client pursue a case in a state where he knew it would likely get dismissed so he could profit off the client and make thousands of dollars. The client spoke with other lawyers who confirmed that many of the things Robert told the client were not true.
Robert Fantone and Andrew Mancilla are partners at Mancilla & Fantone LLP. Mancilla & Fantone LLP is a law firm based in New York handling federal and state criminal and civil cases in NY and NJ. Robert Fantone refused to file paperwork for a case unless the client doubled the retainer, he repeatedly insisted on doubling the size of retainer from 15k to 30k. Robert Fantone held onto the client's retainer for 3 months after the end of client-attorney relationship. Robert held onto the retainer because he intended to come up with reasons to bill the client for the rest of retainer such as providing updates for his removal as the attorney from the case.
Robert Fantone acts like he wants to help clients but he only cares about making money. Robert Fantone takes advantage of the fact that clients don't know the law and uses it to manipulate them, knowing his clients are dependent on him to explain and interpret legal papers. Robert Fantone consistently lied to a client's face while charging them thousands of dollars for his legal counsel and services. Robert Fantone tried to convince a client that a motion was written by the other party who's not an attorney and not the other party's attorney when the motion was obviously written by an attorney. When the client confronted Robert about all of his deceit and lies, Robert didn't deny any of it.
Andrew Mancilla has been Robert Fantone's partner for many years and works with Robert on all their cases. Andrew Mancilla is aware of Robert Fantone's lies, deception and conduct and continues working with him. As long as Andrew Mancilla and Robert Fantone are making money, they don't care about ethics or harming their clients. Robert Fantone has likely taken advantage of many of his clients. The client has evidence of Robert Fantone lying. Andrew Mancilla and Robert Fantone only care about making money, they are unopposed to scamming or lying to clients to enrich themselves and promoting their business with fake positive reviews.
